Terms and Conditions - Mindset First Tutoring

These Terms and Conditions apply to all tuition and courses delivered by Mindset First Tutoring (Victoria Sheers, referred to as “I”, “me” or “the tutor”). By enrolling a student, you (the parent/guardian and/or student) agree to these terms.

1. Tuition and Courses Offered

  • I provide both one-to-one tuition and small group programmes (2-4 students).

  • Small group programmes are structured in blocks. Each block will specify dates, costs, and payment deadlines.

2. Payment Terms

  • One-to-one tuition: Payment is required in advance by bank transfer and must be received no later than 24 hours before the lesson.

  • Courses/programmes: Payment is required in advance by bank transfer, either in full or in two instalments:

    • Half prior to the block starting.

    • Half before the fourth week of the block.

  • Late payment: A £10 late payment fee will be applied to invoices outstanding more than 7 days after the due date. Failure to pay may result in suspension of tuition and, where necessary, further action to recover fees.

3. Cancellations and Rescheduling

  • One-to-one tuition: At least 6 hours’ notice is required to cancel or reschedule. Cancellations with less notice will forfeit the lesson fee.

  • Courses/programmes: Withdrawal must be requested at least 2 weeks before the next block begins. No refunds will be issued after this point.

  • If a student misses a group session, no refund or reschedule is offered. Resources and written guidance will always be provided. A recording may also be made available for catch-up purposes, but this requires the consent of all parents/guardians of students in the group. A discounted one-to-one catch-up may be offered at my discretion, subject to availability.

  • Tutor cancellation: If I need to cancel due to illness or emergency, I will reschedule where possible, rollover payment to the next block, or provide a refund.

4. Lesson Expectations

  • Students must attend on time, prepared with pen and paper (preferably a dedicated workbook), and ensure their laptop/PC is charged and working.

  • Behaviour should remain respectful at all times towards myself and other students. Disruptive or inappropriate behaviour may result in exclusion from the session or programme.

  • Students must be appropriately dressed (as if attending an in-person lesson).

  • Parents/guardians are responsible for providing a safe environment for online learning. Students should not be home alone during lessons. As per safeguarding best practice, lessons should take place in a communal area (not a closed bedroom).

5. Safeguarding and Recordings

  • All online sessions may be recorded for safeguarding purposes and to support student learning.

  • Parental/guardian consent for recording is required before lessons begin.

  • Recordings are stored securely, used only for their intended purpose, and retained for 30 days before deletion.

  • Missed sessions: Resources and written guidance will always be provided. A recording may also be made available for catch-up purposes, but only where all parents/guardians of students in the group have given consent.

  • Recordings are never shared outside the enrolled group. Parents/students must not record, copy, or distribute lesson recordings.

6. Professional Standards

  • I hold an Enhanced DBS certificate (current at time of writing and updated as required).

  • I maintain full professional indemnity and public liability insurance through PolicyBee.

  • I regularly undertake CPD, including safeguarding training, to ensure safe and effective practice.

7. GDPR and Data Protection

  • Personal data (names, contact details, student information) is collected and stored securely for the purpose of providing tuition.

  • Data will not be shared with third parties without explicit consent, unless required by law.

  • You have the right to access, amend, or request deletion of your data at any time.

8. Satisfaction Guarantee

  • A free consultation is offered prior to enrolment, to ensure the programme or tuition is the right fit.

  • I do not offer trial sessions, but I operate a satisfaction guarantee: if you are not satisfied after the first paid lesson of a programme or one-to-one tuition, you may withdraw and receive a refund for any remaining lessons not yet taken.

9. Limitation of Liability

  • While I will take every reasonable step to support student progress, I cannot guarantee specific exam outcomes or grades.

  • Parents/guardians remain responsible for ensuring students meet school/college requirements outside of tutoring.

10. Academic Integrity

  • Tutoring is designed to support student learning and build independent skills.

  • I will not complete homework, coursework, or controlled assessments on behalf of students.

  • I may provide guidance, feedback, and practice activities to help students understand and complete their own work.

11. Agreement

By enrolling a student in tuition or a programme, you confirm that you have read, understood, and agreed to these Terms and Conditions.
